Acceptance of Terms

By accessing and using the services provided by responluna B.V. ("responluna," "we," "our," or "us"), including our website, restaurant services, catering, and event planning, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our services.

These Terms constitute a legally binding agreement between you and responluna B.V., a company registered in the Netherlands with registration number V632025674 and VAT number NL50176314B02, located at Beukenlaan 22, 1351 LT Almere, Flevoland, Netherlands.

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting on our website. Your continued use of our services after any changes constitutes acceptance of the new Terms.

Description of Services

responluna operates a restaurant chain providing fine dining experiences, private event services, catering, and wine pairing services throughout the Netherlands. Our services include:

  • Restaurant dining services at our various locations
  • Table reservations and booking management
  • Private event planning and hosting
  • Corporate and personal catering services
  • Wine pairing and sommelier consultations
  • Online information and booking through our website

User Obligations and Conduct

When using our services, you agree to:

  • Provide accurate and complete information when making reservations or bookings
  • Arrive punctually for confirmed reservations
  • Treat our staff, facilities, and other guests with respect
  • Comply with our restaurant policies and procedures
  • Pay all charges associated with your use of our services
  • Notify us promptly of any changes or cancellations
  • Use our website and services only for lawful purposes

You agree not to:

  • Engage in disruptive, abusive, or inappropriate behaviour
  • Damage or misuse our property or facilities
  • Violate any applicable laws or regulations
  • Use our services for any commercial purpose without prior written consent
  • Attempt to gain unauthorised access to our systems or data
  • Share or distribute content from our website without permission

Reservations and Bookings

All reservations are subject to availability and confirmation by responluna. We reserve the right to refuse service or cancel reservations at our discretion, particularly in cases of:

  • Capacity limitations
  • Previous violations of our policies
  • Safety or security concerns
  • Force majeure events

Cancellation Policy

  • Standard Reservations: Must be cancelled at least 2 hours before the reserved time
  • Large Groups (8+ people): Must be cancelled at least 24 hours in advance
  • Private Events: Cancellation terms will be specified in the event contract
  • Catering Services: Must be cancelled at least 48 hours before the scheduled service

Late cancellations or no-shows may result in cancellation fees as outlined in your booking confirmation.

Payment Terms

Payment for services may be required at the time of service or as specified in your booking agreement. We accept various payment methods including cash, credit cards, and bank transfers. All prices are quoted in Euros (EUR) and include applicable VAT unless otherwise stated.

Pricing and Fees

  • Menu prices are subject to change without notice
  • Service charges may apply for large groups or special events
  • Corkage fees apply for outside wine with prior approval
  • Deposit requirements may apply for event bookings
  • All prices include Dutch VAT at the applicable rate

Food Safety and Dietary Requirements

responluna is committed to food safety and quality. We follow all applicable food safety regulations and maintain high standards of hygiene and preparation. However, please note:

  • You must inform us of any food allergies or dietary restrictions when booking
  • While we take precautions, we cannot guarantee complete absence of allergens
  • Our kitchens handle various ingredients including nuts, gluten, dairy, and seafood
  • Special dietary accommodations require advance notice
  • You dine at your own risk regarding food allergies and sensitivities

Intellectual Property

All content on our website, including text, images, logos, recipes, and design elements, is the intellectual property of responluna B.V. or our licensors and is protected by Dutch and international copyright and trademark laws.

You may not:

  • Copy, reproduce, or distribute our content without written permission
  • Use our trademarks, logos, or brand names without authorisation
  • Create derivative works based on our content
  • Use our content for commercial purposes
  • Remove or alter copyright notices or proprietary markings

The responluna name, logo, and related marks are trademarks of responluna B.V. Unauthorised use of our trademarks is strictly prohibited.

Privacy and Data Protection

Your privacy is important to us. Our collection, use, and protection of personal data is governed by our Privacy Policy, which forms part of these Terms. By using our services, you consent to our data processing practices as described in our Privacy Policy.

Limitation of Liability

To the maximum extent permitted by Dutch law, responluna's liability for any damages arising from your use of our services is limited as follows:

Excluded Damages

responluna shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

  • Loss of profits, revenue, or business opportunities
  • Loss of data or information
  • Personal injury not caused by our negligence
  • Damage to reputation or goodwill
  • Third-party claims or actions

Maximum Liability

Our total liability for any claim shall not exceed the amount paid by you for the specific service giving rise to the claim, or €500, whichever is greater.

Exceptions

Nothing in these Terms shall limit our liability for:

  • Death or personal injury caused by our negligence
  • Fraud or fraudulent misrepresentation
  • Gross negligence or willful misconduct
  • Any other liability that cannot be excluded by Dutch law

Force Majeure

responluna shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to:

  • Natural disasters, extreme weather, or environmental emergencies
  • Government actions, regulations, or restrictions
  • Public health emergencies or pandemics
  • Labour strikes or disputes
  • Supplier failures or shortages
  • Technical failures or cyber attacks

In such events, we will make reasonable efforts to minimise disruption and may offer alternative arrangements or refunds as appropriate.

Termination

We may terminate or suspend your access to our services immediately, without prior notice, for any reason, including but not limited to:

  • Breach of these Terms of Service
  • Violation of applicable laws or regulations
  • Inappropriate or disruptive behaviour
  • Non-payment of charges
  • Fraudulent or suspicious activity

Upon termination, your right to use our services ceases immediately. Termination does not relieve you of any obligations to pay outstanding charges or comply with these Terms regarding past use of our services.

Effect of Termination

Upon termination:

  • All rights granted to you under these Terms will cease
  • You must immediately stop using our services
  • Outstanding payment obligations remain in effect
  • Provisions that by their nature should survive termination will continue to apply

Governing Law and Jurisdiction

These Terms of Service are governed by and construed in accordance with the laws of the Netherlands. Any disputes arising from or relating to these Terms or your use of our services shall be subject to the exclusive jurisdiction of the Dutch courts.

For consumers within the European Union, nothing in these Terms affects your statutory rights under applicable consumer protection laws.

Dispute Resolution

Before initiating formal legal proceedings, we encourage you to contact us directly to resolve any disputes. We are committed to working with you to find a fair and reasonable solution.

EU consumers may also use the European Commission's Online Dispute Resolution platform available at ec.europa.eu/consumers/odr/.

Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect. The invalid provision shall be replaced by a valid provision that most closely reflects the original intent.

Entire Agreement

These Terms of Service, together with our Privacy Policy and any specific service agreements, constitute the entire agreement between you and responluna regarding your use of our services. They supersede all prior agreements, understandings, or communications, whether written or oral.
